Article 1: Definitions
- BIKEBAZE: BIKEBAZE B.V., registered with the Dutch Chamber of Commerce under number 93204485, with its registered office at Stationsplein 45, 3013AK Rotterdam, the Netherlands.
- Services: all services and products that BIKEBAZE offers to consumers as described, but not limited to, on the BIKEBAZE website: the provision of SafeTags and subscriptions.
- Distance contract: a contract concluded between the trader and the consumer within the framework of an organised system for the distance sale of products, digital content and/or services, whereby up to and including the conclusion of the contract exclusive or partial use is made of one or more techniques for distance communication.
- Bicycle: a means of transport with at least two wheels that is propelled by muscle power via pedals, whether or not with electric pedal assistance. It does not matter whether the bicycle is subject to an obligation to take out motor vehicle liability insurance.

Article 2: Applicability
- These Terms and Conditions apply to every offer made by BIKEBAZE and to every distance contract concluded between BIKEBAZE and the consumer.
- The annulment or nullity of any provisions, in whole or in part, occurring in these terms shall not affect the validity of all remaining provisions of these terms, in whole or in part.
- These Terms and Conditions are made available to the consumer before a contract is concluded. Where this is not possible, BIKEBAZE will indicate how the Terms and Conditions can be inspected at BIKEBAZE and that they will be sent free of charge at the consumer's request. If the distance contract is concluded electronically, contrary to the previous sentence, before the contract is concluded the Terms and Conditions may be made available to the consumer electronically in such a way that they can easily be stored by the consumer on a durable medium. If this is not reasonably possible, before the distance contract is concluded it will be indicated where the Terms and Conditions can be inspected electronically and that they will be sent to the consumer electronically or otherwise free of charge upon request.
Article 3: Right of withdrawal
- The consumer may return the contract regarding the purchase of the product to BIKEBAZE within 14 days without stating reasons. The consumer will then receive a refund of the purchase amount. Shipping costs are borne by the consumer.
- If the consumer wishes to return the product after 14 days but within 30 days, BIKEBAZE will decide whether the return is accepted and whether the consumer receives a voucher or discount code instead of a refund. The value of the voucher or discount code is determined solely by BIKEBAZE.
- The consumer must handle the packaging and the purchased product with care, and will only unpack or use the product to the extent necessary to determine the nature, characteristics and operation of the product. The starting point here is that the consumer may only handle and inspect the product as they would be allowed to do in a shop.
- The consumer is only liable for any decrease in value of the product and packaging resulting from handling the product in a way that goes beyond what is permitted in the preceding paragraph. Damage to packaging in such a way that the packaging of the product can no longer be reused in the same condition is one of the reasons to charge a decrease in value to the consumer. BIKEBAZE will always indicate in what way the product has decreased in value when it invokes such a decrease.
- If the consumer exercises the right of withdrawal as described in this article, they will notify BIKEBAZE as soon as possible and in an unambiguous manner. As soon as possible, but within 14 days of notifying that they are exercising the right of withdrawal, the consumer will return the product or hand it over to BIKEBAZE. The consumer will in any case have observed the return period if they return the product before the cooling-off period has expired. As soon as the consumer has allowed the period to expire, BIKEBAZE has the right to refuse a return.
- It is possible that the consumer purchases various products from BIKEBAZE that are not always compatible with each other. If this is the case, it is stated in the product description. It is not possible to request a return after the period in paragraph 1 if the consumer indicates that the products are not compatible with each other.
- BIKEBAZE may exclude the following products and services from the right of withdrawal, provided BIKEBAZE has clearly stated this at the time of offer, or at least in good time before the conclusion of the contract:
- Products manufactured to the consumer's specifications, which are not prefabricated and which are manufactured on the basis of an individual choice or decision of the consumer, or which are clearly intended for a specific person;
- Products that can no longer be reused by BIKEBAZE after use, such as a non-removable or hard-to-remove SafeTag.
- After purchasing a product or service involving a recurring payment, such as a subscription, the user must notify BIKEBAZE through ‘My account’ one calendar day before the subscription expires that they no longer wish to use the service.
- The consumer has the right to terminate the agreement with BIKEBAZE in the case of a subscription. The consumer is not entitled to a refund of amounts already paid. The bicycle remains in the BIKEBAZE database until the agreement expires.
Article 4: Payment
- When purchasing products or services to which a recurring payment applies, such as subscriptions, the user grants BIKEBAZE the right to debit the agreed amount from the consumer's account annually. The consumer expressly agrees to this. The consumer is informed in advance about the annual debit.
- If the consumer has transferred their bicycle as referred to in Article 7 and did not complete the transfer form on the BIKEBAZE website correctly, or did not properly terminate the agreement after transfer of the bicycle, the consumer is bound to the payment in the next period for the subscription with due observance of the previous paragraph.
Article 5: Liability
- The SafeTags, or a registration of the bicycle without a SafeTag, only have a preventive effect in terms of security and cannot prevent the consumer's bicycle from being stolen. BIKEBAZE is not liable for any damage to the consumer if the bicycle is stolen.
- BIKEBAZE is not liable for damage to the bicycle after installation of the SafeTags. The SafeTags are stickers that are difficult to remove, designed to prevent the sticker from being removed after theft. The consumer acknowledges that the sticker may leave traces after voluntary removal or may affect the paintwork of the bicycle.
- BIKEBAZE forbids the consumer from actively searching for a stolen bicycle and thereby coming into contact with the person who committed the theft. BIKEBAZE accepts no liability if the consumer does so. Consumers must always involve the competent authorities in case of theft.
- BIKEBAZE is not liable for any damage to the consumer if the SafeTags are installed on any item or good other than a bicycle.
- The BIKEBAZE platform, the SafeTags and all subscriptions are intended for personal, non-commercial use. Any other use of these services and materials without the prior written consent of BIKEBAZE is strictly prohibited.
- The consumer is responsible for the correctness and timeliness of the information they provide when registering their bicycle. Changes to personal data or bicycle information must be reported to BIKEBAZE immediately. BIKEBAZE accepts no liability following the entry of incorrect information.
- BIKEBAZE is not liable for the non-fulfilment of obligations due to force majeure, such as, but not limited to: natural disasters, wars, epidemics and strikes.
Article 6: Use of data and products
- Before SafeTags are applied, they must be activated via the BIKEBAZE platform.
- BIKEBAZE collects and uses personal data such as name, email address and other information submitted via our forms. This data is used to deliver our services, to gain insight into the problem of bicycle theft, to communicate with end consumers and to develop effective strategies for prevention and awareness. Information submitted by the consumer about the status of their bicycle, such as upon bicycle registration and theft reporting, is used to gain insight into bicycle-theft patterns. This data may be shared with businesses and government bodies to help them better understand and respond to the problem of bicycle theft.
- BIKEBAZE reserves the right to contact the consumer with questions about our products or for customer research. By submitting a form, consumers consent to such communication.
- By submitting a theft form, none of the user's contact details are made visible to third parties. When someone scans the SafeTag on the bicycle or looks up the frame number, that person (the scanner) may voluntarily choose to share additional information with the rightful owner: the location of the scan (only if the browser geolocation prompt is explicitly granted) and/or a name, phone number, email address and a message (only if the scanner fills in these fields on the scan form). Any information shared by the scanner is passed exclusively to the rightful owner of the bicycle, to enable direct communication when the bicycle is recovered.
Article 7: Transfer of bicycle
- If the consumer sells or otherwise delivers their bicycle to a third party, BIKEBAZE must be informed via its transfer form available on the BIKEBAZE website.
- If the consumer transfers their bicycle to a third party in the correct manner, in the case of a subscription this thereby terminates the agreement.
- If the consumer has not taken out a subscription but still receives BIKEBAZE's services, the consumer must complete the transfer correctly. If the consumer fills in the transfer form incorrectly, the new user cannot make use of BIKEBAZE's services.
Article 8: Amendment
- BIKEBAZE has the right to change these terms if it deems this necessary. This paragraph therefore constitutes a unilateral amendment clause and applies to all contracts. BIKEBAZE will inform the consumer electronically of the new terms. If the consumer does not agree to the changes, the consumer has the right to reject the Terms and Conditions and must cancel their subscription, after which BIKEBAZE will stop the services to the consumer 28 days after cancellation. If the consumer has a lifetime entitlement to BIKEBAZE's services and has rejected the new Terms and Conditions, BIKEBAZE has the right to stop the services to the consumer 28 days after the new Terms and Conditions have been rejected.
- If a consumer does not agree to the new Terms and Conditions, they must contact BIKEBAZE about this in writing via the website.
Article 9: Choice of law
- Agreements between BIKEBAZE and the consumer to which these Terms and Conditions relate are governed exclusively by Dutch law.
- Disputes shall be submitted exclusively to the District Court of Rotterdam.
